Forces video embeds contained in dropdowns to have a size --><style>.dropdownizer__dropdown iframe { width: 100% !important; height: 100% !important; }<\/style>\n<p>Vassar College&nbsp;has released the results of its October 2024 Sexual Violence Campus Climate Survey, offering an in-depth look at students\u2019 experiences and perceptions related to safety, education, and prevention efforts on campus.<\/p>\n\n\n\n<p>The survey provides valuable insight into how students view the overall safety of the campus environment, the effectiveness and accessibility of education and training programs, and individual experiences with sexual violence and harassment. It also highlights students\u2019 perspectives on bystander awareness and intervention, helping to identify both strengths and areas that require continued attention and improvement.<\/p>\n\n\n\n<p>The findings are intended to inform ongoing prevention, response, and support initiatives&nbsp;and to guide institutional efforts to foster a safer, more inclusive campus community. Vassar College follows state and federal nondiscrimination laws, and we remain firmly committed to our nondiscrimination policy\u2013which includes protections based on gender identity, expression, and sexual orientation.&nbsp;<\/p>\n\n\n\n<p>In February 2025, the U.S. Department of Education reinstated the 2020 Title IX regulations introduced during the first Trump administration. As a result, federally-funded schools must update their Title IX policies. Vassar\u2019s <a href=\"https:\/\/offices.vassar.edu\/institutional-equity\/policies\/\" target=\"_blank\" rel=\"noreferrer noopener\">Title IX Policy<\/a> and resolution procedures are being updated as follows.\u00a0\u00a0<\/p>\n\n\n\n<p><strong>What\u2019s Changing<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Definition of Sexual Harassment: <\/strong>Schools must return to the \"severe, pervasive, and objectively offensive\" standard&nbsp;for assessing sex-based harassment, replacing the 2024 standard of \u201csubjectively and objectively offensive\u201d and \"sufficiently severe or pervasive.\"&nbsp;<\/li>\n\n\n\n<li><strong>Live Virtual Hearing<\/strong>: We will return to a live virtual hearing format for Title IX complainants (only), with cross-examination conducted by the parties' advisors.<\/li>\n\n\n\n<li><strong>Refined Policies<\/strong>: We're simplifying policy language for clarity and accessibility. A redesigned website with visual guides will launch by the end of the Spring semester to streamline navigation and understanding.<\/li>\n<\/ul>\n\n\n\n<p><strong>What Hasn\u2019t Changed:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li><strong>Nondiscrimination Protections: <\/strong>The College\u2019s <a href=\"https:\/\/offices.vassar.edu\/institutional-equity\/discrimination-and-harassment\/\" target=\"_blank\" rel=\"noreferrer noopener\">Nondiscrimination Policy<\/a> explicitly addresses a wider range of protected characteristics that aligns with and reflects our educational mission and values as a liberal arts institution.<\/li>\n\n\n\n<li><strong>Supportive Measures: <\/strong>We will continue to provide <a href=\"https:\/\/offices.vassar.edu\/institutional-equity\/supportive-measures\/\" target=\"_blank\" rel=\"noreferrer noopener\">supportive measures<\/a>, even if there is no formal complaint, that are free, non-punitive and do not unreasonably burden either party.<\/li>\n\n\n\n<li><strong>Equitable Procedures<\/strong>: Relevant procedures are designed to promote fairness, impartiality, and transparency. Vassar offers a variety of resolution paths providing flexibility, particularly for parties who wish to engage in voluntary informal resolutions.<\/li>\n\n\n\n<li><strong>Decision-Making<\/strong>:&nbsp; Trained external decision-makers handle Title IX hearings and administrative resolutions, promoting fairness and applying the \u201cpreponderance of the evidence\u201d standard.&nbsp;<\/li>\n\n\n\n<li><strong>Advisor Support<\/strong>: Complainants and respondents may access an advisor throughout the formal complaint and resolution process, including an attorney, or an appointed advisor at no cost. A support person may also accompany them.<\/li>\n<\/ul>\n\n\n\n<p>We are actively monitoring for additional regulatory updates, and we will continue to seek input from the Title IX Student Advisory Committee, Faculty Policy and Conference Committee (FPCC), the Campus Climate Committee, and General Counsel. Brian joins the College as the Institutional Equity and Title VI Coordinator. He is a subject matter expert on Title IX\/VI topics, campus climate, instructional design, informal\/alternative resolutions, and facilitated dialogue\/mediation. He is the author of over twenty books and dozens of research articles. Brian is an internationally renowned speaker on behavioral intervention, threat assessment, Title IX\/VI, crisis preparedness, mental illness, FERPA\/HIPAA, and law enforcement policy. He has provided consulting services and created educational programs for colleges and universities across the country and has spent time as a child and family therapist, university professor, assistant deputy director of training at Secure Community Network, partner at TNG, and president of the National Association for Behavioral Intervention and Threat Assessment (NABITA) and trainer with the Association of Title IX Administrators (ATIXA).<\/p>\n\n\n\n<p>Brian believes we must address messages of hate and\/or discrimination by building relationships and understanding the underlying perspectives that drive threatening and\/or discriminating behavior. Through these interactions, we grow and learn from our experiences and dialogue with one another. Forces video embeds contained in dropdowns to have a size --><style>.dropdownizer__dropdown iframe { width: 100% !important; height: 100% !important; }<\/style>\n<p>Dear Members of the Campus Community,&nbsp;<\/p>\n\n\n\n<p>As you may know, the Equal Opportunity and Affirmative Action\/Title IX Office (EOAA\/TIX) has been working hard over the summer to put into effect revised campus policies in compliance with new federal Title IX regulations, which take effect today, August 1, 2024.&nbsp;We have implemented a unified <a href=\"http:\/\/go.vassar.edu\/policy\/reg\/discrimination\">Interim Policy Against Discrimination, Harassment, and Sexual Misconduct<\/a> and <a href=\"https:\/\/go.vassar.edu\/policy\/reg\/discriminiationrres\">Resolution Procedures<\/a> in time to meet the implementation deadline.&nbsp;<\/p>\n\n\n\n<p>See the <a href=\"http:\/\/go.vassar.edu\/eoaa\/2024InterimSummary\">summary of changes to Vassar\u2019s Policy Against Discrimination, Harassment, and Sexual Misconduct and Resolution Procedures<\/a>.&nbsp;We are implementing training for all employees and students to ensure they are familiar with the changes. Those programs will begin in August and then be repeated annually. Additionally, the EOAA\/Title IX student interns are working hard to develop easy-to-understand flowcharts, resource guides, and FAQs to help our campus community understand the important policy changes, their rights, and options for confidential support and resolution through the College<\/p>\n\n\n\n<p>Vassar\u2019s interim policy resulted from the work of a broad campus-wide working group that began meeting last year&nbsp;to determine how to integrate the Final Rule into current College policies and practices. The policy working group included representatives from the Committee on College Life, FPCC, SAVP, VSA, General Counsel, and the Title IX Student Advisory Committee. Title IX governs the College\u2019s response to sex-based discrimination and sexual violence. The working group advocated for a unified model to ensure that the College\u2019s reporting, response, and resolution procedures would be consistent, transparent, and easier to understand. The goal was to adopt a process that consistently and equitably resolves all forms of protected class discrimination and harassment\u2013regardless of whether the individuals involved are faculty, administrators, students, or staff.&nbsp;<\/p>\n\n\n\n<p>The timing of the release of the new regulations and the August deadline mean that the Interim Policy has yet to be reviewed through the College\u2019s shared governance process. Thus, at the start of the fall semester, EOAA\/TIX will hold listening sessions for the campus community. We will also solicit input from the Committee on College Life and Faculty Policy and Conference Committee (FPCC) before presenting to the Faculty later this fall, in accordance with the Governance.<\/p>\n\n\n\n<p><strong>Note on Title IX Injunctions<\/strong>: The 2024 Title IX regulations have faced multiple legal challenges, as recently as July 31. Forces video embeds contained in dropdowns to have a size --><style>.dropdownizer__dropdown iframe { width: 100% !important; height: 100% !important; }<\/style>\n<p>On Friday, April 19, the Department of Education (DoE) released its new Title IX regulations of the Education Amendments Act of 1972, which prohibit discrimination based on gender in educational programs and activities that receive federal funding. The new regulations are a result of the DoE\u2019s consideration of numerous comments from impacted individuals, legal experts, and colleges and universities like Vassar. They include a broader definition of sex discrimination and sex-based harassment, an expansion of critical protections for the LGBTQI+ community and pregnant and parenting students, and the reinstatement of protections for students reporting sexual assault and harassment. Importantly, the regulations maintain equitable due process protections for complainants and accused individuals. The new regulations also rescind the mandate for live hearings with cross-examination through advisors\u2014unless required by state law.&nbsp;<\/p>\n\n\n\n<p>Because the new regulations were issued so late in our academic year and have an implementation deadline of August 1, 2024, Vassar\u2019s Title IX Policy will be revised over the summer. In the meantime, our current policies and procedures remain in effect. This past year, EOAA\/TIX proactively convened a working group consisting of members from the Title IX Student Advisory Committee, Committee on College Life, the Faculty Policy and Conference Committee (FPCC), and the College\u2019s General Counsel to discuss how the College would comply with the proposed regulations and what choices will best support Vassar\u2019s culture, resources, and institutional needs\/goals. After implementing a new interim policy for the fall semester on August 1, 2024, EOAA\/TIX will hold additional listening sessions with students, faculty, administrators, and staff before working with FPCC to bring the revised policy to the Faculty Meeting for a discussion and, for any specific areas not defined by federal or state law, a vote.<\/p>\n\n\n\n<p>As we navigate these changes together, we understand that you may have questions or concerns.
